Most Important Terms and Conditions ("T&C") for Wallet

As a holder of Wallet of the Bank, the Customer is subject to the below t&C. Any changes to the t&C shall be available on the website of the Bank i.e. www.airtel.in/bank and the use of banking services by the Customer is subject to the acceptance of these t&C. By enrolling/applying for the Bank’s Wallet, the Customer acknowledges that the Customer has read, understood and agrees to be bound by t&C. Customer further understands that the below-stated t&C is merely a brief of detailed terms and conditions available on https://www.airtel.in/bank/static/terms-conditions-savings, and is subject to and governed by these detailed terms and conditions. Customer further agrees to read through the detailed terms and conditions and agreed to it before opening a Wallet with the Bank. Terms used herein but not defined are defined in the detailed terms and conditions.

The below mentioned points are to be considered as t&C for wallets:-

A.       Classification:-

 1.       “Airtel Payments Bank Min. KYC Wallet (with no cash loading facility)” shall mean an Airtel Payments Bank Wallet classified as small prepaid payment instrument issued by the Bank by accepting minimum Customer details and having unlimited validity.

2.       “Airtel Payments Bank Min. KYC Wallet (with cashloading facility)” shall mean an Airtel Payments Bank Wallet classified as small prepaid payment instrument issued by the Bank by accepting minimum Customer details with a limited validity (as mentioned under clause C.1 of these terms & conditions).

B.       Account limits:-

1.       The Customer may note that withdrawing cash from the Wallet is not allowed. Any outstanding amounts in the Wallet must be utilized only to make payments for bona-fide Transactions.

2.       The maximum monetary value that can be stored in a month in an Airtel Payments Bank Min. KYC Wallet (with cashloading & without cashloading facility) is INR 9,000/- (Rupees Nine Thousand Only). 

3.       The Customer maintaining an Airtel Payments Bank Min. KYC Wallet (with cashloading & without cashloading facility) issued by Airtel Payments Bank shall be subjected to monthly credit limit of Rs 9,000/- (Rupees Nine Thousand) and yearly credit limit of Rs 1,10,000/- (Rs. One Lac Ten Thousand Only). 

4.       The Customer maintaining Airtel Payments Bank Min. KYC Wallet (with cashloading facility) issued by Airtel Payments Bank shall be subjected to yearly cash loading limit of Rs 49,999 (Rupees forty nine thousand nine ninety nine)

5.       The maximum monetary value that can be transferred under Domestic Money Transfer for any walk in Customer in a single month is INR 25,000 (Rupees Twenty Five Thousand Only) and is also subject to a per transaction limit of Rs 5,000 (Rupees Five Thousand Only). 

6.       No interest will be paid on wallet balances.

7.       Such wallets shall be reloadable in nature. Loading / Reloading of a wallet with no cash loading facility shall be from a bank account / credit card / full-KYC PPI;

 

C.       Validity:-

1.       The Customer maintaining the Airtel Payments Bank Min. KYC Wallet (with cashloading facility) issued by Airtel Payments Bank shall ensure that such Airtel Payments Bank Wallet are converted into Savings Bank Account within a period of 24 months from the date of issue of such Airtel Payments Bank Wallet to the Customer, failing which no further credit shall be allowed in such Airtel Payments Bank Wallet. However, the Customer shall be allowed to use the balance available in the Airtel Payments Bank Wallet. Further,  no wallet shall be issued to same Customer.

 

D.      Inactive Wallets, Dormancy & Closure:-

1.       In case there are no financial transactions initiated by Customers in the Airtel Payments Bank Wallet for a continuous period of one year (excluding system generated transactions, such as, towards deduction of applicable charges) then, as per RBI guidelines, the Wallet would be treated as 'Inactive' by the Bank after giving due notice to the Customer. Customer agrees that the Wallet  status would change to 'Active' only on Customer's Instruction in this regard and after updating of the KYC details, as deemed necessary by the Bank. Customer understands that until the wallet status is 'Inactive', Transactions will not be allowed by the Bank.

2.       The Customer agrees that the Bank may close the wallet accounts, with NIL balance, at its discretion in case where:

          i.      The wallet remains in inactive state for a continuous period of more than 6 months: or;  

          ii.      The registered mobile number of the Customer appears in the Mobile Number Revocation List (MNRL) issued by TRAI

          iii.      If there are Wallets opened with bad/foul names, having NIL balance, the same shall also be closed.

 

E.       Applicable Charges:-

1.       Applicable charges and cash back shall be applicable as per in schedule of charges published by bank, may vary from time to time. Please refer Annexure (Point G) for the same.

 

F.       Others:-

1.       The Customer shall at all times maintain only single relationship (type of Airtel Payments Bank Wallet) with Airtel Payments Bank and shall promptly inform Airtel Payments Bank in case of any violation or default in the same so as to enable Airtel Payments Bank to initiate appropriate action for blocking/closing any such secondary/alternate Wallet.

2.       The value stored in the Airtel Payments Bank Wallet shall not be refunded under any circumstances except in the event of Wallet closure. The Customer must utilise the value stored in the Airtel Payments Bank Wallet to make payments for bona-fide transactions. 

3.       The amount to the credit of any Account in India with the Bank which has not been operated upon for a period of ten (10) years or any deposit or any amount remaining unclaimed for more than ten (10) years shall be credited to the Depositor Education and Awareness Fund (Fund), within a period of three months from the expiry of the said period of ten (10) years. The Fund shall be utilized for promotion of depositors’ interest and for such other purposes which may be necessary for the promotion of depositors’ interests as specified by RBI from time to time. The depositor would, however, be entitled to claim from the Bank his/her deposit or any other unclaimed amount or operate her account after the expiry of ten (10) years, even after such amount has been transferred to the Fund. The Bank would be liable to pay the amount to the Customer/depositor/claimant and claim refund of such amount from the Fund. 

4.       The Customer shall be solely responsible for the confidentiality, safety and security of the M- PIN. The Customer shall be the sole owner of the M-PIN and shall be responsible for the consequences arising out of any disclosure of the M-PIN to any third person/party/entity/organization and/or due to the unauthorized use/access of the Customer’s Airtel Payments Bank Wallet. In case the M-PIN is lost or misplaced, the Customer shall promptly inform the Bank by calling at the Customer care numbers where after the M-PIN will be barred and a new M-PIN will be issued to the Customer after such appropriate and necessary validation checks by Airtel Payments Bank. In case the mobile phone/ SIM card associated with the Airtel Payments Bank Wallet is lost/stolen/misplaced/ no longer in the Customer’s control or possession or operational, the Customer shall promptly inform the Bank. 

5.       The Bank may modify, terminate and/or suspend Airtel Payments Wallet of the Customer anytime, due to any changes in internal policies, rules, regulations and laws set by relevant authorities/regulators. Customer understands and agrees that the Bank has the right to freeze the Wallet if it is suspected that operations in the Wallet are being carried out in disproportion to his/her profile and/or source of funds are not known to the Bank OR suspend or close the Wallet for reasons including directed by the regulator or government body or quasi-judicial bodies or on insolvency / incompetency of the Customer or in case of suspicious transactions are reported to the Bank.  Changed Terms and Conditions will be displayed on the Bank's website or sent through SMS, USSD etc.

Schedule of charges Min KYC & Full KYC Wallets

Maintenance Charges:

1) If you have Min KYC Airtel Money Wallet and have not transacted for 6 calendar months Airtel Payments Bank is entitled to levy a wallet maintenance fee of Rs20 and deduct it from your existing Wallet Balance.

2) If you have Min KYC Airtel Money Wallet and have not transacted for 7th ,8th ,9th ,10th ,11th  calendar months Airtel Payments Bank is entitled to levy a wallet maintenance fee of Rs10 and deduct it from your existing Wallet Balance.

3) If Wallet Balance is less than Wallet Maintenance Charge, then the entire wallet balance will be debited and wallet balance will become zero.

4) If the Wallet Balance is more than Wallet Maintenance Charge, then charges will be debited as per schedule mentioned above.

5) Incase customer initiates atleast one transaction of minimum amt. Rs50 during the month of charging, cashback will be initiated equivalent to the amount charged.

1 DEFINITIONS

1 DEFINITIONS

Airtel Payments Bank Limited (erstwhile known as Airtel MCommerce Services Limited) is a company incorporated under the Companies Act, 1956/2013 with its registered office at Bharti Crescent, 1, Nelson Mandela Road, Vasant Kunj, Phase II, New Delhi - 110070, India and Principal Office at Airtel Center, Plot No 16, Udyog Vihar, Phase-IV, Gurgaon-122015 (hereinafter referred to as the “Bank” or “Airtel Payments Bank”).

The terms and conditions subject to which the Airtel Payments Bank Wallet(s) are issued by the Airtel Payments Bank are provided herein (‘Terms and Conditions’). The use of Airtel Payments Bank Wallet(s) by the Customer is subject to the acceptance of the Terms and Conditions. By enrolling/applying for the Airtel Payments Bank Wallet, the Customer acknowledges that the Customer has read, understood and agreed to be bound by these Terms and Conditions contained herein.

1.1   “Access Channel” shall mean the method used by the Customer to access the Airtel Payments Bank Wallet which includes USSD, IVR, website or the smartphone application available on the google play store and the apple app store. 

1.2 “Applicable Laws” shall mean and include all such statues, regulations, rules, amendments, directives, directions, guidelines, notifications, circular, judicial pronouncements and administrative guidelines that may be in force etc. issued by the Government, State or any governmental or statutory or regulatory authority as made applicable on the Parties from time to time.

1.3  "Airtel Payments Bank Wallet" shall mean the pre-paid payment instrument offered by Airtel Payments Bank vide the permission granted by Reserve Bank of India (RBI) to issue the same. Airtel Payments Bank issues the following Wallets: a Minimum KYC Wallet (with no cash loading facility) b. Full KYC Wallet c. Aadhaar OTP Wallet d. Minimum KYC Wallet (with cashloading facility)

1.4 "Airtel Payments Bank Full KYC Wallet & Airtel Payments Bank Aadhaar OTP Wallet” shall mean an Airtel Payments Bank Wallet classified as semiclosed system payment instrument issued by the Bank post completion of the full KYC details or via Aadhar OTP validation process as prescribed by the RBI master directions and PML Rules 2005, as amended from time to time. 

1.5  "Charge(s)" or "Service Charge" shall mean the charges which the Bank may levy upon the Customer for availing/using the Airtel Payments Bank Wallet(s). 

1.6  "Customer" shall mean Indian residents above the age of 18 years who has registered with the Bank for availing the Airtel Payments Bank Wallet and who has accepted these Terms and Conditions and owns a compatible mobile phone that supports Airtel Payments Bank Wallet . 

1.7  “Domestic Money Transfer” refers to the money remittance facility offered to Customers who do not have access to formal banking channel. 

1.8  “Airtel Payments Bank Min. KYC Wallet (with no cash loading facility)” shall mean an Airtel Payments Bank Wallet classified as small prepaid payment instrument issued by the Bank by accepting minimum Customer details and having unlimited validity.

1.9  “Airtel Payments Bank Min. KYC Wallet (with cashloading facility)” shall mean an Airtel Payments Bank Wallet classified as small prepaid payment instrument issued by the Bank by accepting minimum Customer details with a limited validity (as mentioned under clause 4.11 of these terms & conditions).

1.10  “Fund” means ‘The Depositor Education and Awareness Fund’ established by the Reserve Bank of India under the provisions of the Banking Regulation Act, 1949. 

1.11 "KYC" stands for Know Your Customer and refers to the various norms, rules, laws and statutes issued by RBI from time to time under which the Bank is required to procure personal identification details and authorization from the Customer as may be required at the time of enrolling for Airtel Payments Bank Wallet and/ or on a later date, for availing and / or continuation of the Airtel Payments Bank Wallet. 

1.12 "Merchant Establishment" shall mean and include physical merchants, remote merchants, electronic commerce merchants, mobile commerce merchants and/or any other merchants who have been authorized by the Bank to accept payment for goods or services or financial services using the Airtel Money Account. 

1.13 "M-PIN" shall mean the secret numeric password used to secure Airtel Payments Bank Wallet without knowledge of which the Airtel Payments Bank Wallet may not be operable. 

1.14 “Registration Form” shall mean the digital form to be completed in writing by the Customer along with necessary supporting documents, as required by the Bank for enrolling for the Airtel Payments Bank Wallet.

1.16 “Savings Bank Account” shall mean an account in the name of the Customer registered with Airtel Payments Bank.

1.17 "Transaction" shall mean any credit and debit of money balance in the Customer’s Airtel Payments Bank Wallet including but not limited to financial services or Domestic Money Transfers or payment for purchase of goods or services at all identified Merchant Establishments.

1.18 "USSD" means Unstructured Supplementary Services Data and refers to a method of accessing and using the Airtel Payments Bank Wallet, i.e. by dialing a specified short code from the mobile number registered with the Bank for Airtel Payments Bank Wallet. 

1.19 “Wallet to Wallet Transfer" refers to a facility provided by the Bank whereby an Airtel Money Full KYC & Airtel Money Aadhaar OTP Wallet Customer can transfer funds to any other Airtel Payments Bank Wallet issued by Airtel Payments Bank. 

1.19 “Wallet to Bank Transfer” refers to a facility provided by the Bank whereby an Airtel Money Full KYC Wallet & Airtel Money Aadhaar OTP Wallet Customer can transfer funds to a savings account.  Not allowed incase of Min. KYC Wallet.

2. INTERPRETATION

2.1    All references to singular include plural and vice versa and the word "includes" should be construed as "without limitation". 

2.2    Words importing any gender include the other gender. 

2.3    Reference to any statute, ordinance or other law includes all regulations and other instruments and all consolidations, amendments, re-enactments or replacements for the time being in force. 

2.4    All headings, bold typing and italics (if any) have been inserted for convenience of reference only and do not define limit or affect the meaning or interpretation of these Terms. 

3. DOCUMENTATION

3.1    The collection, verification, audit and maintenance of correct and updated Customer information is a continuous process and the Bank reserves the right, at any time, to take steps necessary to ensure compliance with all relevant and applicable KYC requirements. The Bank reserves the right to discontinue services/ reject applications for Airtel Payments Bank Wallet at any time if there are discrepancies in information and/or documentation provided by the Customer. 

3.2    Any information provided to the Bank with the intention of securing Airtel Payments Bank Wallet shall vest with the Bank, and may be used by the Bank, for any purpose consistent with any applicable law or regulation, at its discretion. This information can also be shared with third parties and used for promotional and analytical purposes. 

3.3    For any information provided by the Customer to the Bank for any purpose, via any medium, Customer is solely responsible for the correctness of that information. If the information provided by Customer is found to be incorrect or erroneous, the Bank holds no responsibility and is not liable for any consequences that the information may carry. If the Customer finds out any information related to his/her account is incorrect or erroneous, he or she can reach out to the Bank to notify the same. If the Bank finds out that the information provided by Customer is false or erroneous, Bank holds the right to terminate the Customer’s account and forfeit the amount lying in the account. 

4. GENERAL CONDITIONS OF AIRTEL PAYMENT BANK WALLET(s)

4. GENERAL CONDITIONS OF AIRTEL PAYMENT BANK WALLET(s)

4.1   The Customer will be issued, Airtel Payments Bank Min. KYC Wallet immediately after successful registration and after due mobile verification and appropriate declarations being received by Airtel Payments Bank. The Wallet can be upgraded to a Full KYC Wallet on submission of required KYC details by the Customer either at the time of registration or at a later date when the same are verified and approved by the Bank after following the due process. 

4.2   The Customer may credit the Airtel Payments Bank Wallet using any of the methods mentioned at www.airtel.in/bank. The list of cash-in outlets, limits and methods of crediting Airtel Payments Bank Wallet are subject to change as per discretion of the Bank. The Customer can keep itself updated with such updated/new location(s) by visiting by visiting www.airtel.in/bank.

4.3   The Customer shall at all times maintain single type of Airtel Payments Bank Wallet with Airtel Payments Bank and shall promptly inform Airtel Payments Bank in case of any violation or default in the same so as to enable Airtel Payments Bank to initiate appropriate action for blocking/closing any such secondary/alternate Wallet.

4.4   The Customer may note that withdrawing cash from the Airtel Payments Bank Wallet is not allowed. Any outstanding amounts in the Airtel Payments Bank Wallet must be utilized only to make payments for bona-fide Transactions. 

4.5   Airtel Payments Bank Wallet for Bharti Airtel Limited mobile connection holders is available on all the Access Channels subject to the Customer’s mobile handset supporting these Access Channels. Airtel Payments Bank Wallet for other telecommunications service provider mobile connection holders is available only on the smartphone application available on the Google play store and the apple app store. 

4.6   Airtel Payments Bank Wallet are non-transferrable and the Wallet issued to the Customer can in no manner be transferred to any other person/entity/organisation.

4.7   The maximum monetary value that can be stored at any point of time in an Airtel Payments Bank Full KYC Wallet & Airtel Payments Bank Aadhaar OTP wallet is INR 99,000/- (Rupees Ninety Nine Thousand Only). 

4.8   The maximum monetary value that can be stored in a month in an Airtel Payments Bank Min. KYC Wallet (with cashloading & without cashloading facility) is INR 9,000/- (Rupees Nine Thousand Only). 

4.9   The Customer maintaining an Airtel Payments Bank Min. KYC Wallet (with cashloading & without cashloading facility) issued by Airtel Payments Bank shall be subjected to monthly credit limit of Rs 9,000/- (Rupees Nine Thousand) and yearly credit limit of Rs 1,10,000/- (Rs. One Lac Ten Thousand Only). 

4.10  The Customer maintaining Airtel Payments Bank Min. KYC Wallet (with cashloading facility) issued by Airtel Payments Bank shall be subjected to yearly cash loading limit of Rs 49,999 (Rupees forty nine thousand nine ninety nine)

4.11  The Customer maintaining the Airtel Payments Bank Min. KYC Wallet (with cashloading facility) issued by Airtel Payments Bank shall ensure that such Airtel Payments Bank Wallet are converted into Savings Bank Account within a period of 24 months from the date of issue of such Airtel Payments Bank Wallet to the Customer, failing which no further credit shall be allowed in such Airtel Payments Bank Wallet. However, the Customer shall be allowed to use the balance available in the Airtel Payments Bank Wallet;

4.12 The maximum monetary value that can be transferred under Domestic Money Transfer for any walk in Customer in a single month is INR 25,000 (Rupees Twenty Five Thousand Only) and is also subject to a per transaction limit of Rs 5,000 (Rupees Five Thousand Only). 

4.13 For transactions through USSD, the maximum permitted value of a single Transaction is INR 5,000 (Rupees Five Thousand Only). 

4.14 These limitations stated in clauses 4.7, 4.8, 4.9, 4.10, 4.11 & 4.12 in line with the regulations, may be reviewed and modified at the discretion of the Bank without any prior intimation to the Customer. 

4.15 Any value in the Customer’s Airtel Payments Bank Full KYC Wallet and Airtel Payments Bank Aadhaar OTP Wallet must be utilized within the validity period of 365 days from the date of last transaction or from the date of activation of the Airtel Payments Bank Wallet, whichever is later.

4.16 The Bank may at its sole discretion introduce appropriate controls and checks including but not limited to revised Airtel Payments Bank Wallet limits. The Bank may request the Customer / beneficiaries of the Airtel Payments Bank Wallet to provide such additional KYC details as part of ongoing monitoring and Customer due diligence which the Customer/beneficiaries shall promptly submit to Airtel Payments Bank without any delay or demur. 

4.17  The Bank reserves the right to suspend/discontinue the Airtel Payments Bank Wallet at any time, for any cause, including, but not limited, to the following-  a. If the Customer is suspected of violating the present terms and conditions and any of the applicable rules, regulations, orders, directions, notifications issued by RBI from time to time; b.  If any details, information, enrolment form or documents submitted by the Customer to Bank are found by Bank or brought to the notice of Bank to be untrue, erroneous, false, misleading, frivolous or fabricated. c.   If Airtel Payment Bank suspects any potential fraud, sabotage, wilful destruction, threat to national security or for any other force majeure event; d.   If the mobile number registered with the Airtel Payments Bank Wallet ceases to be operational or Airtel Payments Bank believes that it is not in the possession or control of the Customer. e.   If Airtel Payments Bank believes, in its reasonable opinion, that cessation/suspension is necessary for any legitimate purpose.

4.18  The Customer maintaining more than one Airtel Payments Bank Wallet issued by Airtel Payments Bank shall be subjected to overall daily limits of Rs.10,000/- (Rupees Ten Thousand Only) for the Minimum KYC Wallets (for cashloading and non-cashloading facility) and/or Rs. 1,00,000 (Rupees One Lacs Only) for the Full KYC Wallet(s)/Aadhar OTP Wallet(s) as the case may be. 

4.19  The value stored in the Airtel Payments Bank Wallet shall not be refunded under any circumstances except in the event of Wallet closure. The Customer must utilise the value stored in the Airtel Payments Bank Wallet to make payments for bona-fide transactions. 

4.20  The amount to the credit of any Account in India with the Bank which has not been operated upon for a period of ten (10) years or any deposit or any amount remaining unclaimed for more than ten (10) years shall be credited to the Fund, within a period of three months from the expiry of the said period of ten (10) years. The Fund shall be utilized for promotion of depositors’ interest and for such other purposes which may be necessary for the promotion of depositors’ interests as specified by RBI from time to time. The depositor would, however, be entitled to claim from the Bank her deposit or any other unclaimed amount or operate her account after the expiry of ten (10) years, even after such amount has been transferred to the Fund. The Bank would be liable to pay the amount to the Customer/depositor/claimant and claim refund of such amount from the Fund. 

4.21  The Customer agrees that the language of any communication relating to Airtel Payments Bank Wallet on the Bank’s website and application shall be in English language. 

4.22  For opening Airtel Payments Bank Wallet using Aadhaar-OTP based e-KYC in non-face to face mode, the Customer shall give specific consent to the Bank for authentication through OTP. 

4.23  The Customer shall agree that the aggregate balance of all deposit accounts with Airtel Payments Bank shall not exceed Rs. 1,00,000/- (Rupees One Lacs Only) at any point of time. In case, the balance exceeds the said limit, the Customer authorizes the Bank to cease operations in the said account till Customer Due Diligence (CDD) is completed. 

4.24 For Airtel Payments Bank Wallet using Aadhaar-OTP based e-KYC in non-face to face mode, the Customer shall agree that the aggregate of all credits in a financial year, in all deposit taken together, shall not exceed Rupees 2,00,000/- (Rupees Two Lacs Only). 

4.25  The Customer understands and agrees that the Airtel Payments Bank Wallet using Aadhaar-OTP based e-KYC in non-face to face mode shall not be allowed for more than one (1) year from the date of opening the Airtel Payments Bank Wallet, within which Biometric based e-KYC authentication must be completed for continuation of the Airtel Payments Bank Wallet. In the event, the Customer fails to complete Biometric based e-KYC authentication within one (1) year, the Customer authorises the Bank to close his/her Airtel Payments Bank Wallet on completion of one (1) year from the date of opening the Airtel Payments Bank Wallet. 

4.26 Upon closure of the Airtel Money Min. KYC Wallet (with cashloading facility andwithout cashloading facility) or Airtel Money Full KYC Wallet or Airtel Money Aadhaar OTP Wallets in accordance with Customer’s or   Airtel Payments Bank discretion and/or at the end of the validity of the Airtel Payments Bank Wallet(s), any financial or non-financial services and/or products (including FASTag, insurance, etc.) shall stand deactivated as well.

4.27 Customer hereby expressly declares that for opening Airtel Payments Bank Wallet using Aadhaar-OTP based e-KYC in non-face to face mode, the Customers has no other wallet opened nor shall it open any other wallet with any other entity/organisation/company in future using Aadhaar-OTP based e-KYC in non-face to face mode. 

4.28   For Airtel Payments Bank Wallet using Aadhaar-OTP based e-KYC in non-face to face mode, the Customer shall undertake that the first credit to the Airtel Payments Bank Wallet shall be effected through the Customer’s full KYC-complied account with another regulated entity. 

4.29  The balance held in the Airtel Payments Bank Wallet is not covered under Deposit Insurance. 

4.30 Airtel Payments Bank can from time to time levy/enforce such limits on loading of money from various payment modes to the Wallet(s) etc. as may be deemed appropriate from time to time in accordance with Applicable Laws, without any prior intimation to the Customer.

4.31 Customers can avail a copy of the “CUSTOMER PROTECTION POLICY” and the “GRIEVANCE REDRESSAL POLICY" in Hindi or other regional languages by calling our customer care center on 400 (Airtel users) or 8800688006 (other mobile connections).  

5 SERVICE CHARGE

5 SERVICE CHARGE

5.1    The Customer shall pay the Service Charges (https://www.airtel.in/bank/bank-charges) prescribed by the Bank in the form and manner as prescribed for such payment of Charges. The Bank may at its discretion, change, amend, increase, modify or reduce the Service Charges from time to time with due notification to the Customer. For schedule of Services Charges please refer company website (www.airtel.in/bank/wallet) or by calling on the Airtel money customer care centre on 400 (Airtel users) or 8800688006 (other mobile connections).

5.2    Any value in the Airtel Payments Bank Wallet that is utilized towards making payments for any Transaction shall be automatically debited from the Airtel Money Account. Bank's responsibility is limited to debiting of the Airtel Payments Bank Wallet and subsequent payment to any Merchant Establishment including financial services or transfers to the Bank. Bank does not endorse, promote, champion or warrant any goods and/or services that might be bought/availed or proposed to be bought/availed using the Airtel Payments Bank Wallet. 

5.3    The Bank reserves the right to recover the applicable Charges for Transactions processed from the balance in the Customer’s Airtel Payments Bank Wallet. 

5.4    In case of shortage of funds in the Wallet of the Customer for debiting the Charges, the Bank reserves the right to debit such outstanding Service Charges from the Wallet of the Customer as and when the funds become available in the Wallet. The Customer agrees and understands that Airtel Payments Bank may at its sole discretion levy limits and/or Charges on the loading of monies to the Wallet from various payment modes and/or on transfer of the monies to the bank accounts

5.5 Wallet Maintenance Charges: 1) If you have Min KYC Airtel Money Wallet and have not transacted for 6 calendar months Airtel Payments Bank is entitled to levy a wallet maintenance fee of Rs20 and deduct it from your existing Wallet Balance. 2) If you have Min KYC Airtel Money Wallet and have not transacted for 7th ,8th ,9th ,10th ,11th  calendar months Airtel Payments Bank is entitled to levy a wallet maintenance fee of Rs10 and deduct it from your existing Wallet Balance. 3)) If Wallet Balance is less than Wallet Maintenance Charge, then the entire wallet balance will be debited and wallet balance will become zero. 4) If the Wallet Balance is more than Wallet Maintenance Charge, then charges will be debited as per schedule mentioned above. 5) Incase customer initiates atleast one transaction of minimum amt. Rs50 during the month of charging, cashback will be initiated equivalent to the amount charged. 6) Wallet Maintenance Cashback will be over and above other cashback.

6. CUSTOMER OBLIGATIONS

6.1    Airtel Payments Bank Wallet availability is subject to the maintenance of an active mobile phone connection with a telecommunications service provider and a mobile phone handset supporting Access Channels. The Customer is solely responsible for all liability arising from the unavailability of the Airtel Payments Bank Wallet due to non-maintenance of an active mobile phone connection with the telecommunications service provider or a mobile handset not supporting the Access Channels. 

6.2    It shall at all times be the Customer’s responsibility to ensure the availability of sufficient funds before executing any Transaction from the Airtel Payments Bank Wallet. 

6.3    The Customer shall be solely responsible for the confidentiality, safety and security of the M- PIN. The Customer shall be the sole owner of the M-PIN and shall be responsible for the consequences arising out of any disclosure of the M-PIN to any third person/party/entity/organization and/or due to the unauthorized use/access of the Customer’s Airtel Payments Bank Wallet. In case the M-PIN is lost or misplaced, the Customer shall promptly inform the Bank by calling at the Customer care numbers where after the M-PIN will be barred and a new M-PIN will be issued to the Customer after such appropriate and necessary validation checks by Airtel Payments Bank. In case the mobile phone/ SIM card associated with the Airtel Payments Bank Wallet is lost/stolen/misplaced/ no longer in the Customer’s control or possession or operational, the Customer shall promptly inform the Bank. 

6.4    The Customer shall only use Airtel Payments Bank Wallet for financial services or Transactions with the approved Merchant Establishment and Bank. 

6.5    The Customer shall intimate the Bank about change in any information, including but not limited to change in address etc. within one week along with such proof of change as per the KYC documents and further provide any such further/other information and documents that the Bank may request from time to time. 

6.6    The Customer shall not use Airtel Payments Bank Wallet for any purpose that might be construed as contrary or repugnant to any Applicable Law, regulation, guideline, judicial dicta, the Bank policy or public policy or for any purpose that might negatively prejudice the goodwill of the Bank. 

6.7    The Customer acknowledges and understands that Airtel Payments Bank Wallet are linked to the mobile phone connection and the Customer shall be solely responsible for any liability arising out of the loss/ theft / misuse of the mobile phone number or deactivation of mobile connection by the telecommunications service provider. 

6.8    The Customer shall ensure that the Airtel Payments Bank Wallet are not used for Transactions in foreign currency. 

7. CONFIDENTIALITY

7.1    Privacy of communication is subject to the terms of the permission granted by the RBI and RBI notifications/directives etc and the Privacy Policy provided at https://www.airtel.in/bank/static/privacy-policy. The Customers understands and agrees that in order to facilitate the provision of Airtel Payments Bank Wallet, the Bank may be required to disclose such information or particulars pertaining to the Customer to any authority, statutory or otherwise as may be required or requested. 

7.2    The user interfaces, graphics, logos, design, compilation, information, computer code (including source code and object code), products, software, services, and all other elements of the Airtel Payments Bank Wallet provided by the Bank (the "Materials") are protected by copyright, designs, patent, and trademark laws, international conventions and other applicable intellectual property and proprietary rights of either the Bank and/or its related Parties. 

7.3    Any information relating to the Customer is generally used to provide the Airtel Payments Bank Wallet, improve the Airtel Payments Bank Wallet and otherwise. For a detailed overview of what kind of information Bank collects, stores, uses, shares, please go through the privacy policy available on the company’s website. 

8. DISCLAIMER OF LIABILITY

8.1    The Bank makes no express or implied warranty, guarantee, representation or undertaking whatsoever regarding the Airtel Payments Bank Wallet, which are not expressly mentioned herein. 

8.2    The Bank shall not be responsible for any acts or omissions of any third party including distributors/retailers/merchants etc., with regard to services which are not expressly authorized by the Bank. 

8.3    The Bank shall not be liable to any person for any delays, loss of business, profit, revenue or goodwill, anticipated savings, damages, fees, costs, expense, etc. or for any indirect or consequential loss, howsoever arising, on Airtel Payments Bank Wallet being unavailable/usage of the Airtel Payments Bank Wallet or otherwise. 

8.4    The Bank shall not be liable to any person for injuries or damages resulting from omissions, interruptions, delays, errors in transmission, failures or defects in equipment, or disconnection of the mobile services by any telecom service provider including Bharti Airtel Limited or any other cause including but not limited to the failure to transmit, or any other causes beyond the control of the Bank or for any reason whatsoever. 

8.5   The Terms and Conditions herein shall be subject to the notifications/ guidelines issued by RBI, from time to time. 

8.6   The Bank will do its best to ensure that Customer Transactions and information remain secure and confidential. The Bank makes no warranty or representation of any kind in relation to the system and the network or their function or performance or for any loss or damage whenever and howsoever suffered or incurred by the Customer or by any person resulting from or in connection with the use of the Airtel Payments Bank Wallet. 

8.7  The Bank does not in any manner warrant or state that the Services, technology platform or the Airtel Payments Bank Wallet so provided by it shall be uninterrupted or error free or free from any virus or other malicious destructive or corrupting code, program or macro.  Airtel Payments Bank hereby specifically disclaims any representations, endorsements, guaranties, or warranties, express or implied, including, but not limited to, the implied warranty of sale-ability or fitness for a particular purpose and non-infringement of intellectual property rights.  

9. INDEMNITY

The Customer agree to indemnify, defend and hold harmless the Bank and/or the related parties from any and all claims, losses, damages, and liabilities, awards, judgements, costs and expenses, including and without limitation legal fees and expenses, arising out of or related to the use or misuse of the Airtel Payments Bank Wallet or due to any violation of these Terms and Conditions, or any breach of the representations, warranties, and covenants.

1.1.    Customer acknowledges, agrees and confirms that  if at any time it is  in the knowledge of Airtel Payments Bank that the Customer has engaged or is engaging in any act or omission to defraud the Airtel Payments Bank, its affiliates, users or otherwise engages in unlawful, fraudulent, suspicious or other activities which suggest malafide intent of the Customer, whether to avail benefits of any offer, cashback, reward or incentive given by Airtel Payments Bank or otherwise, and/or which activities are detrimental to Airtel Payments Bank’s interest, Airtel Payments Bank reserves its right to claw-back or recover the benefits of such offer, cashback, reward or incentive given by Airtel Payments Bank with or without intimation to the Customer, at Airtel Payments Bank’s sole discretion, by debiting the Airtel Payments Bank Wallet  The  right under this Clause is in addition to any other right or legal recourse that Airtel Payments Bank may have under  Applicable  Laws.  

1.2. Any dispute with or complaint against any Merchant Establishment or financial services company or banks must be directly resolved by the Customer with the Merchant Establishment or financial services company or bank, without involving Airtel Payments Bank in any manner. It is clarified that the Bank shall not be responsible or liable for any deficiency in goods and/or services purchased using Airtel Payments Bank Wallet. This exclusion of liability shall apply even for goods and/or services made available by the Bank under promotional schemes. The Customer is instructed to satisfy themselves regarding the quality, quantity and fitness of any good and/or service before purchasing the same. 

1.3. Any amount transferred erroneously by the Customer to any Merchant Establishment or for any financial services company or to a bank account shall not be refunded to the Customer by the Bank in any circumstances. 

1.4. In the event of any dispute, the Bank records shall be binding as the conclusive evidence of the transactions carried out through use of Airtel Payments Bank Wallet. 

1.5. The Bank shall send all Customer communications and transaction alerts by SMS and the SMS shall be deemed to have been received by the Customer after they have been submitted for delivery to the mobile phone operator. The Bank, at its own discretion, may also contact the Customer, for all purposes necessary for providing & improving the Airtel Payments Bank Wallet and suggesting any additional services. 

1.6. The Customer agrees to receive all commercial messages including transactional messages from the Bank. 

1.7.  By agreeing to the Terms and Conditions, user agrees that the details mentioned in the KYC are to be considered as final details for Full KYC Wallet.

1.8.    The customer agrees to the Terms and Conditions and allows Airtel Payments Bank to open a Min. KYC Wallet by accepting the Aadhaar number provided by him/her. 

11. CHANGE OF TERMS

11.1 The Bank has the sole discretion to change, add / or delete and/or amend and/or modify these Terms and Conditions. 

11.2 The Bank may modify, terminate and/or suspend Airtel Money Wallet to the Customer anytime with or without prior notice, due to any changes in internal policies, rules, regulations and laws set by relevant authorities/regulators. 

11.3 Changed Terms and Conditions will be displayed on the Bank's website or sent through SMS, USSD etc. This communication shall be valid and be considered as proper intimation. By continuing to use the Airtel Money Wallet, the Customer will be deemed to have accepted the changed Terms and Conditions. 

12. SEVERABILITY

If any part of this Terms and Conditions is adjudged illegal or inoperable for any reason, the same shall be severed from the remainder of the Terms and Conditions and only that portion of this Terms and Conditions that is specifically adjudged illegal or inoperable shall cease to govern the relationship between the Bank and the Customer. 

13. JURISDICTION

The Courts at New Delhi shall have exclusive jurisdiction in respect of any dispute regarding the use of Airtel Money Wallet including the interpretation and execution of these Terms and Conditions or any other document executed by the Customer or the Bank with respect to Airtel Money Wallet.

I (“the Customer”) agree that the opening and maintenance of Airtel Payments Bank Wallet is subject to rules and regulations introduced or amended from time to time by the Reserve Bank of India. I hereby certify that I have declared my status as per the rules applicable under section 285BA of the Income Tax Act, 1961 as notified by Central Board of Direct Taxes (CBDT) vide Notification No. S.O. 2155(E) dated 7 August 2015 and RBI Circular Ref No. DBR.AML.BC.No.36/14.01.001/2015-16 dated 28 August 2015 in this regard. I understand and acknowledge that as per the provisions of Income Tax Act, Rules made there under and the guidelines issued by the RBI in the matter, depending upon the residential status and/or other criteria stipulated therein, the Bank may have to report the details in respect of Wallet(s) as per the prescribed format to the Central Board of Direct Taxes (CBDT) or other Government Agencies to comply with the obligations as per the Inter-Governmental Agreements (IGA) in respect of Foreign Accounts Tax Compliance Act (FATCA) and Common Reporting Standards (CRS) and or any other similar arrangements. I further declare as under;

14.1 I hereby declare that I am a citizen and tax resident of the Republic of India and not of any other foreign country.

14.2 I  hereby declare that I am currently not a Politically Exposed Person (“PEP”) or family member/relative/close associate of PEP, as defined by the relevant RBI regulations.

14.3 I certify that the information provided by me above as applicable to me by me as well as in the documentary evidence provided by me are, to the best of my knowledge and belief, true, correct and complete and that I have not withheld any material information that may affect the assessment/categorization of my Wallet Account as a U S Reportable Account or Other Reportable Account or otherwise. I undertake the responsibility to declare and disclose within 30 days from the date of change, any changes that may take place in the information provided by me, as well as in the documentary evidence provided by me or if any certification becomes incorrect and to provide fresh and valid self-certification along with documentary evidence.

14.4 I hereby confirm that the proofs/documents provided by me at the time of onboarding are valid and has not expired, wherever applicable. I hereby further undertake to inform to Airtel Payments Bank in writing in case of any change thereof.

14.5 I also agree that my failure to disclose any material fact known to me, now or in future, may invalidate me from transacting in the Airtel Payments Bank Wallet and the Bank would be within its right to put restrictions with respect to the operations of my Wallet or close it or report to any regulator and/or any authority designated by the Government of India (GOI) /RBI for the purpose or take any other action as may be deemed appropriate by the Bank, under the guidelines issued by CBDT/RBI from time to time, if the deficiency is not remedied by me within the stipulated period.

14.6 I also agree to furnish and intimate to the Bank any other particulars that are called upon me to provide on Airtel Payments Bank Wallet of any change in law either in India or abroad in the subject matter herein.

14.7 I agree to abide by the Bank's Terms and Conditions and rules in force and the changes thereto in T&Cs from time to time relating to my Account as communicated and made available on the Bank's website.

14.8 I give my consent to the Airtel Payments Bank to display my balance in the Wallet/savings bank account on the Airtel Thanks app.

14.9 I understand and acknowledge that there may be downtime, network congestion, outages, scheduled maintenance, or such other events beyond the reasonable control of Airtel Payments Bank and Airtel Payments Bank shall not be responsible for the same.

14.10 I hereby give my express consent and agree to the Bank in sharing my personal details including phone number and email id with a) any of its service providers, business correspondents, credit rating or investigation agencies or any other agencies or entity for the purpose of providing Banking, search, survey and allied services or for providing third party products including insurance, third party loans etc.

14.11 I agree to indemnify and hold harmless Bank against any fraud, loss or damages suffered by Bank due to reason attributable to me including any incorrect information submitted by me and/or failure on my part to communicate the change/alteration in my details/documents. I also hereby agree to indemnify Bank and their successors or assignees or affiliate if any of the representations, information, documents and declarations made or submitted hereunder by me are incorrect, false, fraudulent or misleading in any of its particulars.

 I hereby expressly grant my consent to Airtel Payments Bank for completing my Aadhar OTP based KYC for availing the Airtel Payments Bank Wallet and further state as under:

15.1 That I have no objection to the Aadhaar based authentication system and hereby provide my explicit consent for Aadhaar OTP based verification by Airtel Payments Bank voluntarily. I also give my consent for accessing mobile number and email-id from the Central Identities Data Repository (“CIDR”)/Aadhaar system.

15.2 I understand that I am allowed to delink my Aadhaar and related information from my Account at a later date and to update another valid Proof of Identity (“POI”)/Proof of Address (“POA”) of my choice by contacting wecare@airtelbank.com.

15.3 I hereby consent that the OTP based Aadhaar Authentication as completed by Airtel Payments Bank can be treated as my signature and confirmation for opening of the Airtel Payments Bank Wallet.

15.4 I understand that I can opt to open my Airtel Payments Bank Wallet by using any valid Officially Valid Document (‘OVD’) of my choice while submitting my application for opening of my Airtel Payments Bank Wallet.

15.5 I understand that I may be required to submit filled Registration Form along with prescribed documents designated as OVD  as provided under the  Master Direction - Know Your Customer (KYC) Direction, 2016 issued by RBI and as amended from time to time or supplemented (“KYC Norms”) / Anti-Money Laundering (AML) standards/Combating of Financing of Terrorism (CFT)/Obligation of banks under PMLA, 2002, including Permanent Account No. (PAN) or Form 60/61 from time to time, which is applicable for Aadhaar based authentication system or such other documents as may be required by Airtel Payments Bank (in case I do not have a PAN), to the satisfaction of the Bank and such other/further documents including in respect of the nature of business and financial status as may be required by the Bank as per it’s internal checks and as may be required under Applicable Laws including KYC Norms. I will comply with Applicable Laws at all times.

15.6 The information provided by me and my data received from Unique Identification Authority of India (UIDAI) is true and correct for opening the Airtel Payments Bank Wallet through either of the options.

15.7 I understand that my personal /KYC details may be shared by Airtel Payments Bank with the KYC Registry. I hereby give consent to receive information from Central KYC registry or from the Bank through SMS/e mail on my registered number/e mail address.

16. Dormant Wallet

In case there are no transactions initiated by Customers in the Bank Wallet for a continuous period of one year (excluding system generated transactions, such as, towards deduction of applicable charges) then, as per RBI guidelines, the Wallet would be treated as 'Dormant' by the Bank. Customer agrees that the Wallet  status would change to 'Active' only on Customer's Instruction in this regard and after updating of the KYC details, as deemed necessary by the Bank. Customer understands that until the wallet status is 'Dormant', transactions will not be allowed by the Bank.

The Customer agrees that the Bank may close the wallet accounts, with NIL balance, at its discretion in case where:

1.       The wallet remains in dormant state for a continuous period of more than 6 months: or;  

2.       The registered mobile number of the Customer appears in the Mobile Number Revocation List (MNRL) issued by TRAI

Notice to this effect has been placed on the website of the Bank and the same may be viewed at: https://www.airtel.in/bank/terms/webwallet/Dormant_Wallet_Notice.pdf

An SMS communication will be sent to the customer, only in cases where the registered mobile number is not a part of the MNRL, intimating about wallet closure at least 7 days before the wallet closure activity. During these 7 days, the customer may choose to upgrade their dormant wallet to a Savings Account by downloading Airtel Thanks App.
